This approach makes it possible to build the defense not around general statements, but around facts, evidence and specific violations by the other side.

The defense involved checking the circumstances relied on by the migration authority and proving that there were no sufficient grounds for forced expulsion in the specific situation.

Particular attention was paid to the sequence of events, the content of the challenged documents, the authority of the body that made the decision and whether the client’s safeguards were respected during the review. In court disputes with public authorities, these details often become decisive: even when an authority refers to its powers, it must act within the law, properly substantiate its conclusions and duly assess the evidence.

Work With Evidence

During preparation of the position, the case materials, primary documents, decisions and procedural steps preceding the court claim were analyzed. The attorney’s task was to show the court not only the final outcome of the dispute, but also the logic of the defense: why the opponent’s decision was wrong, which facts were left without proper assessment and what legal consequences this created for the client.
