Case Overview

The tax authority applied to the court to confirm an administrative seizure of the taxpayer’s property. For a business, such a seizure can effectively block operations and create pressure in a dispute with a public authority.

At the start of the work, it was important not to limit the matter to a formal description of the dispute, but to establish which specific actions or decisions created risks for the client, which documents supported the client’s position and which procedural deadlines had to be considered. This approach makes it possible to build the defense not around general statements, but around facts, evidence and specific violations by the other side.

Legal Position

The defense centered on assessing the real grounds for the seizure, the proportionality of such a measure and whether the controlling authority followed the required procedure for applying it.

Particular attention was paid to the sequence of events, the content of the challenged documents, the authority of the body that made the decision and whether the client’s safeguards were respected during the review. The tax authority’s appeal was dismissed, and the decision of the Odesa District Administrative Court refusing the claim was left unchanged.
